Terms & Conditions
Thank you for choosing The Drizzle Bar for your special occasion. Our goal is to make your event sweet, memorable and completely stress‑free. By confirming a booking with The Drizzle Bar, you agree to the following Terms & Conditions.
1. Bookings & Confirmation
- 1.1 All bookings are subject to availability and are secured on a first‑come, first‑served basis.
- 1.2 A booking is only considered confirmed once the required payment has been received and proof of payment has been provided.
- 1.3 A quotation does not constitute a confirmed booking and does not guarantee availability.
- 1.4 Dates and times may be released to other clients until the required payment has been received.
- 1.5 By making payment, the client confirms that they have read, understood and accepted these Terms & Conditions.
2. Payment
- 2.1 The payment required to secure the booking will be stated on the quotation/invoice.
- 2.2 The outstanding balance, where applicable, must be paid by the date specified on the invoice.
- 2.3 The Drizzle Bar reserves the right to cancel a booking where payment has not been received by the agreed deadline.
- 2.4 All payments must be made using the payment details provided on the official invoice.
- 2.5 Proof of payment must be sent to The Drizzle Bar and should include the relevant invoice or booking reference.
- 2.6 Additional services, guest numbers, menu changes, travel fees, extended service time or other requested additions may result in additional charges.
3. Quotations
- 3.1 Quotations are valid for the period stated on the quotation.
- 3.2 Prices may change after the quotation validity period has expired.
- 3.3 The final price is based on the services, menu, guest numbers, duration and requirements agreed upon at the time of booking.
- 3.4 Any changes requested after confirmation may affect the final price.
4. Cancellation by the Client
- 4.1 Cancellations must be submitted to The Drizzle Bar in writing.
- 4.2 No refunds will be given under any circumstances. All deposits and payments made to secure a booking are strictly non‑refundable.
- 4.3 If the client cancels the event date, The Drizzle Bar will retain all payments made to cover committed costs, preparation, ingredients, staffing, stock and loss of the booking opportunity.
- 4.4 A booking may be postponed instead of cancelled, subject to the rescheduling terms in Section 5.
5. Rescheduling
- 5.1 Requests to postpone the event date must be made in writing and are subject to availability.
- 5.2 Postponement is only permitted where a suitable alternative date is available in The Drizzle Bar’s calendar.
- 5.3 The booking may be transferred to the available alternative date confirmed by The Drizzle Bar.
- 5.4 If no suitable alternative date is available, the original booking will remain subject to the cancellation terms in Section 4, and no refund will be provided.
- 5.5 Additional costs may apply where postponement results in increased supplier, staffing, travel or other operational costs.
- 5.6 A postponed booking is not confirmed until the new date has been agreed to in writing by both parties.
6. Guest Numbers & Portions
- 6.1 The quotation is based on the number of guests and servings specified by the client.
- 6.2 The client is responsible for providing accurate guest numbers and serving requirements.
- 6.3 Additional guests or servings may only be accommodated subject to availability and may incur an additional charge.
- 6.4 The Drizzle Bar cannot guarantee sufficient portions for guests exceeding the confirmed number.
- 6.5 Where a package is quoted according to a specific number of servings, portions are allocated according to that package.
- 6.6 If the client’s guests do not consume the full quantity of products ordered, the client will not be entitled to a refund, credit or reduction in the booking price. Products and stock are allocated and purchased specifically for the event and cannot be reallocated to other events.
- 6.7 No reduction in the number of servings or products included in a confirmed booking will be permitted within two weeks before the event date. Any request to reduce the quantity must be submitted in writing at least two weeks before the event and remains subject to The Drizzle Bar’s approval.
7. Menu & Customisation
- 7.1 Menu items and toppings are subject to availability.
- 7.2 The Drizzle Bar reserves the right to substitute an ingredient or item with a suitable alternative if a particular product is unavailable.
- 7.3 Reasonable notice is required for menu changes or customisation requests.
- 7.4 Special menu requests may incur additional charges.
- 7.5 Custom branding, packaging, signage, menus or other personalised elements must be approved by the client before production.
- 7.6 Once personalised items have entered production, changes or cancellations may result in additional charges.
8. Food Allergies & Dietary Requirements
- 8.1 The client is responsible for informing The Drizzle Bar of any known allergies or dietary requirements before the event.
- 8.2 While reasonable precautions will be taken, The Drizzle Bar operates in an environment where various allergens may be present.
- 8.3 We cannot guarantee that food will be completely free from traces of allergens.
- 8.4 The Drizzle Bar cannot accept responsibility for allergic reactions where an allergy was not disclosed to us in advance.
- 8.5 Guests with severe allergies should exercise caution and make an informed decision before consuming any products.
9. Venue & Event Requirements
- 9.1 The client is responsible for ensuring that the venue permits external catering and dessert vendors.
- 9.2 The client must provide The Drizzle Bar with accurate venue information, including access instructions, parking/loading requirements and any venue restrictions.
- 9.3 Where required, the client is responsible for arranging access to suitable electricity, water, shelter and/or other venue requirements communicated before the event.
- 9.4 The Drizzle Bar must be provided with reasonable access to the venue for setup and breakdown.
- 9.5 Delays caused by venue access restrictions, security, parking, loading or other circumstances outside The Drizzle Bar’s control may affect setup or service time.
10. Setup & Service Time
- 10.1 Setup time is separate from the contracted service period unless otherwise stated.
- 10.2 The client must ensure that the designated setup area is clear and ready upon arrival.
- 10.3 The Drizzle Bar cannot be held responsible for delays caused by the venue, client, guests, traffic, restricted access or circumstances beyond our reasonable control.
- 10.4 If the event starts late due to circumstances outside The Drizzle Bar’s control, the original contracted service period will generally still apply.
- 10.5 Additional service time may be requested subject to availability and will be charged accordingly.
11. Equipment, Carts & Property
- 11.1 All carts, equipment, serving items, décor and other property supplied by The Drizzle Bar remain the property of The Drizzle Bar unless otherwise agreed in writing.
- 11.2 The client is responsible for any damage caused to The Drizzle Bar’s equipment or property by the client, venue or guests, excluding reasonable wear and tear.
- 11.3 The Drizzle Bar reserves the right to charge the client for repair or replacement costs resulting from damage, loss or misuse.
- 11.4 Guests may not move, dismantle, operate or interfere with equipment belonging to The Drizzle Bar unless authorised by our staff.
12. Weather & Outdoor Events
- 12.1 For outdoor events, the client is responsible for providing a suitable covered and weather‑protected area where necessary.
- 12.2 The Drizzle Bar reserves the right to stop or modify outdoor service where weather conditions create an unsafe environment for staff, guests, food or equipment.
- 12.3 Where severe weather prevents the safe operation of the service, The Drizzle Bar will work with the client to find a reasonable alternative where possible.
- 12.4 The Drizzle Bar will not be responsible for weather‑related damage, delays or interruptions beyond our reasonable control.
13. Travel, Parking & Venue Fees
- 13.1 Travel, parking, tolls, access fees or other venue‑related charges may apply depending on the event location.
- 13.2 Any applicable fees will be communicated to the client where reasonably possible and may be included in the quotation.
- 13.3 The client is responsible for providing accurate venue and parking information.
14. Client Responsibilities
The client agrees to:
- Provide accurate event details and guest numbers.
- Provide the correct event date, time and venue.
- Ensure suitable venue access.
- Inform The Drizzle Bar of allergies and dietary requirements.
- Ensure that guests treat The Drizzle Bar staff, equipment and property respectfully.
- Ensure that any venue‑specific requirements are communicated in advance.
- Make all required payments by the agreed deadlines.
15. Liability
- 15.1 The Drizzle Bar will take reasonable care in preparing and serving all products.
- 15.2 To the extent permitted by applicable law, The Drizzle Bar will not be liable for losses, delays or damages arising from circumstances outside our reasonable control.
- 15.3 The Drizzle Bar cannot be held responsible for injuries, damage or loss resulting from guests misusing equipment, carts, serving items or other property.
- 15.4 Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by South African law.
16. Unforeseen Circumstances / Force Majeure
- 16.1 The Drizzle Bar will not be liable for failure or delay in performing its services where this is caused by circumstances beyond its reasonable control.
- 16.2 This may include, but is not limited to, severe weather, natural disasters, fire, power outages, road closures, government restrictions, venue closure, serious illness, accidents, supplier failure or other unforeseen circumstances.
- 16.3 Where reasonably possible, The Drizzle Bar will communicate with the client and attempt to provide a suitable alternative arrangement.
17. Photographs & Social Media
- 17.1 The Drizzle Bar may photograph its setup, carts, desserts and event styling for portfolio and marketing purposes.
- 17.2 Where identifiable guests are prominently featured, appropriate permission will be sought where required.
- 17.3 Clients who do not wish for their event setup or products to be used for marketing purposes should notify The Drizzle Bar in writing before the event.
18. Changes to Bookings
- 18.1 All changes to a confirmed booking must be communicated in writing.
- 18.2 Changes are subject to availability and may result in additional charges.
- 18.3 Changes requested shortly before the event may not be possible due to preparation, staffing and stock requirements.
- 18.4 No changes that reduce the number of servings or products ordered will be accepted within two weeks before the event date.
19. Acceptance of Terms
By paying a deposit, making full payment, signing the quotation, confirming the booking in writing, or otherwise instructing The Drizzle Bar to proceed with the booking, the client confirms that they have read, understood and accepted these Terms & Conditions.
The Drizzle Bar reserves the right to update these Terms & Conditions from time to time. The Terms & Conditions applicable to a booking will be those provided to the client at the time of confirmation.
